The National Student Financial Aid Scheme (NSFAS) has urged landlords to not require a deposit or top-up payment from NSFAS-funded students.

"NSFAS reminds accommodation providers of the obligatory conditions, as supplied by the Standardised Fixed-Term Lease Agreement between the personal accommodation vendors and NSFAS funded students," NSFAS explained in a statement on Thursday.

The Standardised Fixed-Term Lease Agreement states the rent will probably be paid regular on the accommodation company (lessor) by NSFAS, on behalf from the lessee (NSFAS funded student), in accordance using the NSFAS conditions and terms for personal accommodation suppliers’ participation on the student accommodation portal.

"The lessor may not involve or permit the lessee to pay a deposit, top-up payments, or some other sorts of payment on the lessor, or some other person in reference to this arrangement, nsfas student document submission deadline together with payment of hire, though awaiting payment from NSFAS. The lessor shall have no recourse in opposition to the lessee for any default during the payment of rent by NSFAS," the arrangement reads.

The NSFAS conditions and terms for private accommodation providers’ participation on the student accommodation portal also states that: "Where nsfas eligibility criteria the NSFAS-funded student is defunded as a consequence of an incorrect selection by NSFAS, the coed won't be chargeable for payment of any arrear rent towards the accommodation company, up right until the date of being defunded."

NSFAS explained that the place the NSFAS-funded student chooses to continue occupying the leased premises, notwithstanding becoming defunded by NSFAS, the student will be liable for website payment of rent into the lessor through the date of being defunded.

The scheme emphasised that any dispute arising between the parties regarding the interpretation or implementation of the agreement, must be dealt with in accordance with any dispute resolution procedure determined by NSFAS for this purpose.
